Terms of Use for GetAgentBy submitting a question to and continuous accessing GetAgent, you are agreeing to the terms of use which can be found below.PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING GETAGENTThe following terms of use are intended to inform users of the limitations and usage guidelines of the artificial intelligence tool ("GetAgent") provided by BTG Technology Holdings Limited (hereinafter referred to as "Bitget", "we" or "our") within the Platform ("Terms"). These Terms are supplemental to and shall be read together with the Bitget Terms of Use ("Terms of Use") which shall continue to apply. All terms and clauses contained in the Terms of Use (except to the extent expressly modified herein) are incorporated by reference and have the same force and effect as if set out in their entirety in these Terms.In the event of any conflict or inconsistency between these Terms and the Terms of Use, these Terms shall prevail with respect to the services contemplated hereunder, unless expressly stated otherwise. We may make changes to these Terms (or any terms or information incorporated by reference) at any time in accordance with the Terms of Use.Unless otherwise defined, capitalized words used in these Terms shall have the same meaning given to them in the Terms of Use. The rules of interpretation set out in the Terms of Use shall apply to these Terms.Please read these Terms carefully before engaging with the Services (as defined below).Services
1.
GetAgent is designed to provide (i) information relating to the products and/or services provided by Bitget within the Platform from time to time; and (ii) administrative assistance with (x) executing any selling, purchasing, or entering into any other type of transaction (
"Transactions") involving Digital Assets, derivatives, other assets or products as Bitget may from time to time permit to be carried out on the Platform, and (y) transferring Digital Assets into or out of your Account (
"Services").

It is hereby clarified that the Services are provided in accordance with the class of membership which you are subscribing to. Bitget GetAgent User Guide (
"User Guide") sets out the details of different classes of GetAgent's membership (
"Membership"), including the applicable subscription fees (
"Subscription Fees"), key benefits and features for each class of Membership. Bitget reserves the rights to update the User Guide including, but not limited to, changes that effect modifications to the Subscription Fees, key benefits and features for each class of Membership, etc., at any time without prior notice.
3.
Bitget reserves the rights to implement new versions and upgrades of GetAgent including, but not limited to, changes that effect modifications to the design, features, operational method, technical specifications, systems and other functions, etc. of GetAgent, at any time without prior notice.
Disclaimer
1.
GetAgent uses generative AI to generate the Outputs. GetAgent may, at times, provide information that is inaccurate or incomplete and may not reflect human expertise. Therefore, we encourage you to verify any information provided by GetAgent before taking any action or making any decisions based on the information received. Bitget assumes no responsibility and does not guarantee the accuracy or completeness of the information provided.

GetAgent uses inputs, including but not limited to, text prompts, image, audio files, documents, data or other content provided by you or used at your direction and/or the metadata processed on and through the Platform (
"Inputs") to generate outputs insights and execution of Transactions (
"Outputs"). You are solely responsible for ensuring or at your own risk to ensure that the Inputs and Outputs comply with applicable laws and these Terms.
3.
Bitget does not guarantee the accuracy or consistency of any Outputs generated by the GetAgent. Given the nature of GetAgent, use of the Services may in some situation result in incorrect Output that does not accurately reflect the action generated. You shall evaluate the accuracy of any Output and shall not rely on Bitget to do so.
4.
Neither Bitget nor any of our directors, employees, affiliated companies and representatives (i) make any representation or warranty that the Services is suitable, available or appropriate, for any user in any location; nor (ii) accept any liability regarding the information provided and cannot be held liable for any actions, losses, or damages resulting from the use of GetAgent.
5.
GetAgent is an artificial intelligence service and should be used at your own risk. We are not liable to you for any loss or damage that was not foreseeable, not caused by our breach or negligence, or any business loss or damage.
6.
The content of Outputs is provided for educational and informational purposes only and does not represent our views. It is not intended to be any endorsement and should not be considered as investment advice or a solicitation to buy or sell digital assets.
7.
Digital Assets are subject to high market risk and volatility. Before making any investment, you should conduct a comprehensive assessment and seek professional advice from a licensed financial advisor. We disclaim all liability for actions taken or not taken based on the Outputs.
8.
To the extent that any Outputs are derived from information provided by third parties, you also agree to the terms and conditions of these third parties. We do not claim any copyright in the materials provided by third parties, or guarantee that they do not infringe other third parties' intellectual property rights. We also do not guarantee the information is accurate, complete or that it is the most up-to-date. Bitget shall not be responsible for the same.
Limitations and restrictions
1.
Whilst all reasonable endeavors have been made to ensure responses are relevant and free from bias, in exceptional cases, some responses generated may be unreliable or offensive to some users. If you have any concerns, you are strongly encouraged to carefully review these Terms and seek independent professional advice as to whether GetAgent or the Services is appropriate for you having regard to your personal circumstances and objectives, financial position and risk tolerance level.
2.
We try to make sure that GetAgent is accurate, up-to-date and free from bugs, but we cannot promise that it will be. Furthermore, we cannot promise that GetAgent will be fit or suitable for any purpose. Any reliance that you may place on the information on the GetAgent is at your own risk.
3.
We may suspend, restrict or terminate access or operation of GetAgent at any times as we see fit. While we try to make sure that GetAgent is available for your use, we do not promise that GetAgent will be available at all times or that your use of the Platform will be uninterrupted.
4.
By using GetAgent, you agree:
1.
that you are solely responsible for all costs and expenses you may incur in relation to your use of Get Agent;
2.
that the Subscription Fees and/or other Services fees (if applicable) paid may not be refunded or be subject to any other arrangement(s) as Bitget considers appropriate;
3.
that GetAgent is a digital tool that combines third-party artificial intelligence with Bitget's product and service range to generate the Output, based on your Input;
4.
not to post, send or share defamatory, offensive, intimidating, illegal, racist, discriminatory, obscene or inappropriate content in any form through GetAgent;
5.
not to use the Services for any use or purpose that breaches any applicable local, state, or federal laws;
6.
not to use GetAgent to conduct illegal or immoral activities;
7.
not to use the Services which violates the intellectual property rights of others;
8.
not to misuse or attack GetAgent by introducing viruses, trojans, worms, logic bombs or any other material which is malicious or technologically harmful (such as by way of a denial-of-service attack);
9.
not to attempt to compromise the security of GetAgent or access confidential information related to the Services;
10.
not to deliberately attempt to prompt GetAgent into generating responses which may be offensive and cause harm or reputational damage to Bitget; or
11.
not to copy, distribute, modify, reverse engineer, decompile or attempt to extract the source code of GetAgent or any components thereof, without our prior written consent.
5.
We reserve the right to remove access to GetAgent or restrict access to certain key benefits and/or features of the Services under the Membership where it is being used in an inappropriate manner, in breach of these Terms or discontinue in subscription of Membership.
Data privacy and security
1.
We prioritize the privacy and security of our users' information. Be aware that GetAgent conversations may be reviewed by our teams to improve results and for training purposes. Do not share in your conversation through GetAgent any personal information that is not useful and/or requested for handling your assistance request.
2.
Your privacy and personal information are important to us. Any personal information that you provide to us will be dealt with in line with our
Privacy Policy, which explains what personal information we collect from you, how and why we collect, store, use and share such information, your rights in relation to your personal information and how to contact us and regulatory/supervisory authorities in the event you have a query or complaint about the use of your personal information.
Ownership, use and intellectual property rights
1.
The intellectual property rights in GetAgent and in any text, images, video, audio or other multimedia content, software or other information or material submitted to or accessible from GetAgent (
"Content") are owned by us.
2.
We reserve all our intellectual property rights (including, but not limited to, all copyright, trade marks, domain names, design rights, database rights, patents and all other intellectual property rights of any kind) whether registered or unregistered anywhere in the world. This means, for example, that we remain owners of them and are free to use them as we see fit.
3.
Nothing in these Terms grants you any legal rights in GetAgent or the Content other than as necessary for you to access it. Our trade marks and other trade marks and trade names may also be used on GetAgent or in the Content. Your use of our trade marks (if any) within GetAgent or in the Content is strictly prohibited unless you have our prior written permission.
Submitting information to GetAgent
1.
While we try to make sure that GetAgent is secure, we do not actively monitor or check whether information supplied to us through GetAgent is confidential, commercially sensitive or valuable.
2.
Other than any personal information which will be dealt with in accordance with our
Privacy Policy, we do not guarantee that information supplied to us through GetAgent will be kept confidential and we may use it on an unrestricted and free-of-charge basis as we reasonably see fit.
