U.S. SEC Questions Legality of REX's Ethereum and Solana Staking ETFs
According to a report by Jinse Finance, the U.S. SEC has raised concerns about the Ethereum and Solana staking ETFs launched by REX Shares and Osprey Funds, suggesting they may not meet the definition of investment companies and ETFs under the Federal Securities Act. The U.S. SEC stated that these funds may have "incorrectly filed registration statements" and that "the disclosure in the registration statements regarding these funds' identity as investment companies may be misleading." REX Financial's General Counsel Greg Collett stated, "We believe we can satisfy the U.S. Securities and Exchange Commission's concerns regarding investment companies, and we do not intend to launch the funds until we achieve this."
